 Court of Appeal Affirms Order for PCTEL, Inc.

Sixth District Court of Appeal Affirms Summary Judgment Order for Bergeson, LLP Client PCTEL, Inc.

On February 6, 2007, the Court of Appeal of the State of California, Sixth Appellate District, issued an opinion affirming the trial court's order granting Bergeson, LLP client PCTEL, Inc.'s motion for summary judgment in Fraser v. PCTEL, Inc. et al., Case No. H028165 (Santa Clara Superior Court No. 1-02-CV806176) (August 16, 2004). Plaintiff Fraser had alleged that he had suffered damages in excess of $1.5 million related to his participation in defendant PCTEL's Secondary Public Offering in April 2000.

Bergeson, LLP attorneys Donald P. Gagliardi and Marc G. van Niekerk represented prevailing party PCTEL, Inc. both in the trial court and on appeal. The Court of Appeal found that the trial court correctly determined that PCTEL established that Fraser was not damaged by any alleged acts or omissions of PCTEL and that Fraser had failed to refute PCTEL's showing, leaving no triable issues of fact.
