Author: Ms. Lotz is a contributing author to the Employment and Labor Matters section of the California State Bar Association Corporations Committee's Guide To Organizing A California Corporation. This guide contains practical advice for California start-up companies regarding various legal issues, including employment law compliance. Topics covered in the Employment And Labor Matters section include: required employer filings with the State and Federal government; Employment Agreements; Employee Confidential Information and Invention Assignment Agreements; Arbitration Agreements; and an overview of various employment laws, including laws related to discrimination and harassment, leaves of absence, workers' compensation, disability, wrongful termination, workplace safety and wage and hour compliance.

Experience: Ms. Lotz's primary area of practice is labor and employment litigation and counseling. She has handled a variety of matters in state and federal courts, in binding arbitration, and before various administrative agencies, including class action matters. Ms. Lotz is experienced in handling claims of discrimination, wrongful termination, harassment, breach of contract, fraud, defamation, Labor Code violations, unfair business practices, and misappropriation of trade secrets. Ms. Lotz also regularly advises employers on day-to-day workplace issues, including terminations and discipline, leaves of absence, wage and hour matters, investigating complaints of harassment, discrimination, and retaliation, protection of confidential information, and employee and customer solicitation issues. In addition, Ms. Lotz has drafted numerous employee handbooks and personnel policies, proprietary information agreements, employment agreements, offer letters, arbitration agreements, employee retention agreements, severance plans, and severance agreements. Ms. Lotz has also advised executives regarding their rights in connection with accepting and departing from employment, including rights and obligations with respect to inventions and proprietary information, as well as assisting them in negotiating employment agreements, retention agreements, proprietary information agreements, and separation agreements. |
