San Francisco County Superior Court grants motion for summary judgment filed by Bergeson, LLP on behalf of four companies and three individuals

On March 23, 2004, the San Francisco County Superior Court granted a motion for summary judgment filed by Bergeson, LLP on behalf of four companies and three individuals. In the Action, plaintiff alleged claims of promissory fraud, breach of fiduciary duty, and rescission. The Court found the promissory fraud claim to be barred by the statute of limitations and the breach of fiduciary duty claim barred by the business judgment rule. With respect to the claim of rescission, Plaintiff conceded that he failed to name a necessary party and any amendment would be futile, as it would be barred by the statutes of limitations. Daniel J. Bergeson, Caroline McIntyre, and Hway-ling Hsu represented the prevailing parties.
