Radiate, Inc. Settles Worldwide Internet Privacy Class Action
Lawsuit
On March 19, 2001, Los Angeles County Superior
Court Judge Anthony J. Mohr gave final approval to a settlement
of a worldwide class action lawsuit brought against Bergeson Eliopoulos'
client Radiate, Inc. Radiate's technology allows advertising to
be distributed worldwide via the Internet. The lawsuit addressed
the developing legal issues relating to Internet privacy, alleging
that Radiate had invaded it's 36,000,000 user's privacy and had
trespassed onto their computers by including codes which start
a dialogue between Radiate's servers and a user's computer. Radiate
demonstrated that it did not collect any private data unvolunteered
by its users. The settlement Judge Mohr approved did not require
Radiate to pay anything to the class and, instead, limited class
relief to a coupon for a discounted sales price of Go!Zilla, Radiate's
popular file transfer protocol program and additional disclosures
to be included on Radiate's web site. Radiate was represented
in the case by partner William T. Eliopoulos, special counsel
Stephen T. Hicklin and associate Tahj E. Gomes.
