Bergeson Eliopoulos Wins Summary
Judgment in International Contract Dispute; Praised by Federal
Judge for Skilled Lawyering
San Jose, California: March 30, 2001 -
Bergeson Eliopoulos, LLP attorneys William T. Eliopoulos and Donald
P. Gagliardi obtained summary judgment in favor of Dillingham
Construction International, Inc. and its joint venture partner,
ABB Susa, in a five-year long Miller Act multi-million dollar
contract dispute arising out of the upgrading and conversion of
a U.S. military air base in Egypt. Not only did the Bergeson Eliopoulos
attorneys provide a complete defense to the plaintiff's various
claims, but obtained a $285,000 judgment on their clients' counterclaims
(the full amount sought) and an award of attorneys' fees of $326,000
(the full amount requested).
In an order filed March 23, 2001 in U.S. ex rel
Navlight v. Dillingham Const. Int'l, Inc. et al., Civ. No. C 96-401
(N.D.Cal.), U.S. District Judge Vaughn R. Walker praised Eliopoulos
and Gagliardi for having done "a very capable job in this
case under sometimes difficult conditions. They [Eliopoulos and
Gagliardi] have proven to be skilled and experienced."
Judge Walker observed in his order, which approved
an award of fees, that, "This was a long and complicated
case. . . . The complexity of the case required the court to employ
a special master . . . The many hours that [Bergeson Eliopoulos]
counsel spent on the case were in the end well-spent. Counsel
delivered a victory for defendants on all claims."
Eliopoulos said that "we are, of course, very
pleased with the result and appreciative of the court's careful
review of the matter as well as its comments concerning our work."
