Bergeson Eliopoulos Obtains Dismissal of Claims against Former Officers and Directors In November and again in December Bergeson Eliopoulos was successful in obtaining the dismissal of claims for violation of California Labor Code Section 203 and 218.5 and breach of contract brought against the former officers and directors of two former corporations based on alleged failure of the corporations to pay its employees all wages due and owing at the time of their closures. In both cases, the courts determined that such claims could only be maintained against the corporate employees and not the officers and directors of the companies. Both motions were successfully argued by Jennifer Lotz.
