The Court Of Appeal Affirms Trial Court's Order In Favor Of Bergeson, LLP Client

On December 14, 2012, the Court of Appeal of the State of California, Sixth Appellate District, affirmed the trial court’s judgment of dismissal in favor of Bergeson, LLP’s client and co-defendants in Kelley, et. al. v. Rambus, Inc. et. al., H037343, Santa Clara County Superior Court No. CV122444. The trial court had sustained defendants’ demurrers to plaintiffs’ complaint on the grounds that res judicata barred each of plaintiff’s causes of action, as their securities fraud claims had already been adjudicated in a federal case that had been dismissed in a final judgment. Daniel J. Bergeson and Caroline McIntyre represented defendant David Mooring in the action.
