Bergeson LLP Clients RapidMiner and Peter Lee Prevail in Appeal of Denial of Petition to Compel Arbitration
Bergeson LLP clients RapidMiner and Peter Lee, represented by Bergeson LLP partner Jaideep Venkatesan, prevailed in their appeal of their petition to compel arbitration in the case TIBCO, Inc. v. RapidMiner, Inc., et al, San Mateo County Super. Ct. No. CIV534404. In 2015 TIBCO sued RapidMiner and several former TIBCO employees, including Mr. Lee, alleging claims of breach of contract, misappropriation of trade secrets and other tort claims. RapidMiner and Mr. Lee filed a petition to compel arbitration on the ground that TIBCO’s claims are based on employment agreements containing provisions requiring arbitration. After the Superior Court denied their petition, RapidMiner and Mr. Lee appealed to the California Court of Appeal for the First Appellate District. The Court of Appeal reversed the Superior Court’s decision in full and remanded the case to the Superior Court.
