Bergeson, LLP Obtains Dismissal In Adaptix, Inc. v. Sony Mobile Communications (USA) Inc.

As noted in The Recorder’s feature article, Grewal Shuts Down NPE’s ‘Groundhog Day’ Suits, Bergeson, LLP client, Sony Mobile Communications (USA) Inc., obtained a dismissal in the United States District Court for the Northern District of California of the lawsuit filed by Acacia Research Group’s subsidiary, Adaptix Inc., asserting patent claims that the Court had dismissed from an earlier filed lawsuit by Adaptix against Sony and several other defendants.  The Court’s ruling was based upon application of the Kessler doctrine, which bars lawsuits against products found to not infringe patents in earlier litigation.  Sony was represented by the Andrews Kurth law firm and by Daniel J. Bergeson, Jaideep Venkatesan, and Clark Stone of Bergeson, LLP.
