Bergeson LLP Secures Dismissal of Trade Secrets Claims Against Proton Management

Bergeson LLP is pleased to announce a significant litigation victory on behalf of Proton Management Ltd. following the dismissal of all claims brought against it by Swan Bitcoin in the U.S. District Court for the Central District of California.

The litigation stemmed from allegations by Swan Bitcoin that Proton and former Swan personnel had misappropriated proprietary assets and trade secrets related to bitcoin mining operations. From the outset, Proton and the individual defendants vigorously disputed the claims, maintaining that Swan did not own the alleged trade secrets or proprietary information at the center of the lawsuit.

In related proceedings in the United Kingdom, Swan ultimately conceded that it did not own the assets, documents, or trade secrets underlying its California claims. Following those admissions, Swan sought dismissal of its own lawsuit, and the federal court subsequently dismissed the action in its entirety as to all defendants.

The dismissal concludes more than eighteen months of litigation and follows several key victories for the defense, including the defeat of Swan’s requests for a temporary restraining order and expedited discovery.

The matter underscores the importance of establishing clear ownership rights before pursuing trade secret claims and demonstrates the effectiveness of a coordinated defense strategy across multiple jurisdictions.
