Trial During COVID-19 Restrictions

On October 26 and 27, Bergeson, LLP Partner John D. Pernick concluded the presentation of evidence in a court trial in the Santa Clara County Superior Court that had begun in February 2020 prior to any of the shelter-in-place emergency orders. The continued proceedings on October 26 and 27 were conducted under the Court’s emergency rules and procedures for trials during the coronavirus pandemic.  Mr. Pernick appeared for the trial in person, with personal protective equipment as ordered by the Court.  Witness examinations were conducted with both in-person witnesses (who testified in the witness box with PPE as well as plexiglass shields in place) and over the Court’s video conferencing technology, with all exhibits projected on the Court’s video monitors and to witnesses over video conference.
